A suspect has been taken into custody in connection with the assassination of a crucial witness who provided testimony before the Madlanga Commission of Inquiry, the commission confirmed on Sunday.
Witness gunned down weeks after testimony
Marius van der Merwe, who appeared before the judicial inquiry under the pseudonym "Witness D" on 14 November 2025, was murdered on 5 December 2025 — barely three weeks after delivering what the commission described as significant evidence. His testimony reportedly exposed allegations of serious misconduct within the City of Ekurhuleni and the Ekurhuleni Metropolitan Police Department (EMPD).
Commission spokesperson Jeremy Michaels confirmed that the inquiry had noted the announcement by police that an arrest had been made in the case. The identity of the suspect has not yet been disclosed.
Van der Merwe's appearance before the commission was considered pivotal in uncovering alleged corruption and irregular conduct linked to municipal structures in the Ekurhuleni metro. His killing sent shockwaves through the inquiry process and raised urgent questions about witness protection.
"The commission urges the relevant law enforcement agencies to ensure justice for the families of all those affected by people who are attempting to resist accountability for their alleged acts of criminality."
Michaels emphasised the importance of holding those responsible to account, particularly individuals allegedly seeking to obstruct the commission's work through intimidation and violence.
Commission's broader mandate
The Madlanga Commission was established to probe allegations of criminality, political meddling and graft within South Africa's criminal justice system. Chaired by Justice Mbuyiseli Madlanga, the inquiry has been tasked with examining claims of unlawful influence and misconduct affecting law enforcement bodies across the country.
The arrest marks a significant development in a case that has underscored the dangers faced by those willing to come forward with evidence of wrongdoing. The commission has previously raised concerns about the safety of witnesses cooperating with the inquiry, and Van der Merwe's murder highlighted the extreme risks involved in exposing alleged corruption at local government level.
The arrest of a suspect in the killing of a Madlanga Commission witness signals progress in protecting those who expose alleged corruption within local government structures. For South Africans, particularly in Ekurhuleni, this case highlights the dangerous intersection of municipal misconduct and violent intimidation that undermines public trust in local institutions. Businesses and residents relying on accountable governance face uncertainty, though a successful prosecution could strengthen future witness cooperation and reinforce the rule of law across municipalities under scrutiny.
