AfriForum and several other organisations have commenced their much-anticipated constitutional challenge against the Expropriation Act, with proceedings now underway at the High Court in Cape Town. The initial hearings this week are centred on procedural issues, with the court tasked with establishing the roles of the various parties and bodies wishing to take part in the matter, including their status as applicants, respondents, or amici curiae.

Ernst van Zyl, who heads public relations at AfriForum, characterised the legal battle as possibly among the most significant South Africa will witness this decade. He emphasised that the ruling will have far-reaching implications for the constitutional right to private property ownership in the country.

Van Zyl told media that private property rights face sustained attacks from multiple directions by those intent on dismantling this fundamental right. He added that AfriForum remains resolute in its opposition to what he termed "agents of chaos" seeking to undermine property ownership.

He further pointed to a speech delivered by President Cyril Ramaphosa in Zimbabwe during August of last year, in which the president reportedly praised the late Robert Mugabe's controversial land reform programme, calling it "ambitious" and "necessary". Van Zyl said this reinforced AfriForum's conviction that the governing ANC intends to use the Expropriation Act as a vehicle for seizing property without compensation, drawing parallels to Zimbabwe's widely criticised land policies.
